1. DEFINITIONS

1. Definitions

"Agreement" — these Terms and Conditions together with the rental confirmation issued by Selesa Ride
"Service" — vehicle rental services provided by Selesa Ride, including Airport Arrival Compact, Kundasang Highland Explorer, and Dive Trip & East Coast Transfer
"We / Us / Our" — Selesa Ride, registered vehicle rental operator in Kota Kinabalu, Sabah, Malaysia
"You / User" — the individual booking and/or driving the rental vehicle
"Vehicle" — any motor vehicle provided by Selesa Ride under this Agreement
"Rental Period" — the time from vehicle collection to vehicle return as agreed at booking

2. Acceptance of Terms

These terms constitute a legally binding agreement between you and Selesa Ride. By submitting a booking request, confirming a reservation, or collecting a vehicle key, you acknowledge that you have read, understood, and agreed to these terms. If you do not agree, you should not proceed with the rental.

You must be at least 18 years of age and hold a valid driving licence to rent from Selesa Ride.

3. Service Description

Selesa Ride provides self-drive vehicle rental services from Kota Kinabalu, Sabah, Malaysia. Our three service categories are:

Airport Arrival Compact — compact vehicles collected at Kota Kinabalu International Airport, from RM 140 per day
Kundasang Highland Explorer — crossover SUVs for highland routes including Kinabalu Park and Kundasang, from RM 350 per day
Dive Trip & East Coast Transfer — highway-maintained vehicles for trips to Semporna, Sandakan, and Tawau, from RM 520 per trip

All prices are in Malaysian Ringgit (RM). Services are available subject to vehicle availability and confirmation from Selesa Ride.

4. Booking and Confirmation

A booking is not confirmed until you receive written or verbal confirmation from Selesa Ride. We reserve the right to decline any booking. Bookings are recommended at least 48 hours in advance of the intended collection time.

5. Driver Requirements

All drivers must be at least 18 years of age
A valid Malaysian driving licence (Class D or equivalent) or international driving permit is required
The licence must be presented at vehicle collection — failure to present a valid licence will result in cancellation without refund
Drivers must not be under the influence of alcohol, drugs, or any substance that impairs driving ability
Additional drivers must be declared at booking and present valid licences

6. Vehicle Use

Permitted use

Driving on legally classified roads within Malaysia
Driving within the designated journey type for which the vehicle was rented

Prohibited use

Off-road or unsealed road driving
Transporting hazardous or illegal materials
Sub-letting or transferring the vehicle to any undeclared driver
Using the vehicle for commercial passenger transport (e.g. ride-hailing services)
Driving outside Malaysia without prior written approval from Selesa Ride
Driving in a manner that violates Malaysian road traffic laws

7. Payment Terms

Rental rates are confirmed at booking. Full payment is required at vehicle collection unless an alternative arrangement has been agreed in advance. Accepted payment methods include cash (Malaysian Ringgit), bank transfer, and major debit/credit cards. A refundable security deposit may be required at collection and will be confirmed at the time of booking.

8. Fuel Policy

Vehicles are provided with a full fuel tank and must be returned at the same level. If the vehicle is returned with less fuel than provided, a fuel replenishment charge at current retail pump prices will be applied to the deposit or invoiced separately.

9. Rental Period and Extensions

The rental period is as agreed at booking. If you wish to extend the rental, you must notify us at least 24 hours before the scheduled return time. Extensions are subject to availability and additional charges at the applicable daily rate. Returning a vehicle late without prior notification may incur additional fees.

10. Damage and Insurance

All vehicles carry comprehensive motor insurance. In the event of an accident or damage:

Do not admit liability or make payments to any third party
Obtain a police report if required by circumstances or if legally mandated
Complete the incident report provided by Selesa Ride

The renter may be liable for an excess amount in the event of a claim, as specified at booking. Damage caused by prohibited use is excluded from insurance coverage and the full repair cost will be the renter's responsibility.

11. Cancellation Policy

Cancellations made more than 24 hours before the confirmed collection time will be accepted without penalty. Cancellations made within 24 hours of collection may be subject to a cancellation fee equivalent to one day's rental. No-shows without prior notice will be charged the full confirmed rental amount.

12. Disclaimers

Selesa Ride provides vehicles in good mechanical condition, as verified through our pre-rental inspection process. However, we do not guarantee uninterrupted vehicle performance under all conditions. Selesa Ride is not responsible for:

Loss of income or consequential losses arising from vehicle failure
Damage to personal property stored in or transported in the vehicle
Delays caused by road conditions, weather, or circumstances beyond our control

13. Limitation of Liability

To the maximum extent permitted by Malaysian law, Selesa Ride's liability to you for any claim arising from this agreement shall not exceed the total rental fees paid for the relevant rental period. We exclude all liability for indirect, consequential, or special damages.

14.

14. Indemnification

You agree to indemnify and hold harmless Selesa Ride and its team from any claims, losses, or costs arising from your breach of this Agreement, misuse of the vehicle, or violation of Malaysian road traffic laws during the rental period.

15.

15. Governing Law and Disputes

These terms are governed by the laws of Malaysia. Any dispute arising from this Agreement shall first be subject to informal resolution through direct communication with Selesa Ride. If unresolved, disputes shall be subject to the jurisdiction of the courts of Kota Kinabalu, Sabah.

16.

16. Changes to Terms

Selesa Ride reserves the right to update these Terms and Conditions. The revised version will be published at selesaride.world/terms-conditions.html with an updated effective date. Continued use of our services after updates constitutes acceptance of the revised terms.
